Bauer OBD Customer Terms and Conditions

This Agreement is between the Premium Index Card Holder (“You” or “advertisers”) whose business details are shown on the order form and invoice associated with this Agreement and BAUER CONSUMER MEDIA LIMITED (“Bauer”), a company incorporated in England and Wales (company number 01176085) whose registered office is at 21 Holborn Viaduct, London, EC1A 2DY (“Bauer”); and Central Index Limited (“We” or “Company”) Company number 06002202, registered in England and Wales with its primary place of business at 431 London Road, Camberley GU15 3HZ , (together “the parties”).

The Agreement consists of the following Terms and Conditions:

1.The Agreement will be activated upon receipt of a Company approved Order Form, and payment will be due within 7 days of your receipt of an electronic invoice by email.

2.You are activating a Premium Index Card, or a number of Premium Index Cards as specified on the associated Order Form on the Online Business Directory (OBD) hosted on the Bauer websites FHM.com, Empireonline.com, Zootoday.com, Closeronline.co.uk, Heatworld.com

3.This OBD is being promoted via the websites, which are the property of Bauer

4.Your Premium Index Card account will be active for the Initial period of 12 months, or another period as shown on your Order Form.

5.You will be supplied with a username and password to edit your business details at any time via the Index Card management website at www.centralindex.com.

6.You warrant that you will keep the username and password secure at all times, and alert us if you have any reason to believe that this information has been gained by a third party.

7.Photographs and logos must be supplied for the authorisation of Company and Bauer before being published to your Premium Index Card on your chosen OBD. These may be taken from Advertiser’s website if permission is given at the point of Order.

8.You warrant that you are entering accurate information and that nothing on your Premium Index Card (including any images) will be misleading.

9.From time to time Company or Bauer may contact you to update you about the service and provide support on your account.

10.From time to time Company or Bauer may, but are not obliged to, promote your business by making information in your Index Card available via channels other than the OBD. To facilitate this you hereby grant Company and Bauer a world wide royalty-free license to make the information contained in your Premium Index Card available via websites, directories, email, SMS and any other on and off-line media for the purpose of promoting the OBD or your Business.

11.You are wholly responsible for the data entered into your Premium Index Card and agree not to use the service in order to engage in any illegal or unlawful activities.

12.Company will securely store the details displayed in the Premium Index Card, in accordance with the Data Protection Act 1998.

13.Company will endeavour to ensure that the service is available at all times; in the event of interruptions Company will use all reasonable endeavours to expedite a resolution.

14.You agree that if you are NOT the authorised person, for example the business owner or their representative and you enter information falsely into a Premium Index Card of any business, then you accept full liability for any damages caused.

15.Company and Bauer reserve the right to remove a Premium Index Card from the system if either Company or Bauer reasonably consider that the information supplied was not by an authorised individual of that business, or that it is defamatory, offensive, illegal, misrepresentative or otherwise objectionable.

16. In the event that Company and Bauer terminate their agreement, at the election of Company and Bauer, your Premium Index Card may be transferred to an alternative service provider, or a prorata portion of your payment refunded based on the term remaining in your Order Form.

17.These Terms and Conditions shall be governed, construed and shall take affect in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English courts.

18.Please contact Company with any queries on support@centralindex.com and your query will be dealt with as soon as possible.

19.These Terms and Conditions may be subject to change and will be updated on the OBD website from time to time.
